Rule 109
Departmental inquiry not required
In the following cases, the officer empowered to order punishment shall not be subject to departmental inquiry in relation to the following departmental punishment to any civil servant;-
(a) In case of general punishment as per clause (a) of section 59 of the Act.
(b) If a civil servant whose absconders are not found or it is impossible to establish contact due to any other reason, departmental punishment should be imposed.
(c) If a civil servant has to be given departmental punishment on the basis of being found guilty by the court in a criminal charge of moral turpitude.
(d) If the employee found guilty by the court on charges of corruption is to be punished departmentally.

(1) In the case of gazetted posts, in order to be promoted in civil service, group or sub-group vacant posts by performance evaluation and seniority and performance evaluation, employees with the minimum service period and educational qualification as per section 21 of the relevant service, group or sub-group under the relevant service, group or sub-group in the case of gazetted posts.
